Premises Liability

Premises Liability

Premises liability is the responsibility or liability a land owner holds to ensure a visitor is not injured by the conditions of their property. It includes a multitude of circumstances. For example, a poorly lit or maintained property with tripping hazards such as broken steps or sidewalks or other conditions that could lead to a slip and fall injury or death.

Another illustration is faulty equipment located on the property like an elevator or amusement park ride that causes an injury. Depending on the type of equipment, this may also fall under Product Liability law. Special care must also be taken when there is a swimming pool, trampoline, swing set or jungle gym on the premises, to ensure children remain safe while on the property.

Pet owners are also responsible for their pets and injuries they may cause to guests. Dog bites would be an example where a property owner may be liable.
